Register of Delegations and Authorisations

Delegations and Authorisations allow for Council staff (and, in limited circumstances, Council contractors) to perform certain powers, duties and functions.

Delegations and Authorisations are a highly effective means of streamlining decision-making and enables Council to concentrate on the broader strategic issues rather than administrative and routine matters. Mansfield Shire Council has many delegations under a wide range of legislation, and such arrangements are appropriate given the diversity of services provided by Council.

Delegations

S5 Instrument of Delegation ─ Council to Chief Executive Officer(PDF, 762KB) - Used by Council to delegate all of Council's powers, duties and functions which are capable of delegation, subject to some exceptions and limitations, to the CEO pursuant to s11(1) (b) of the Local Government Act 2020.

S6 Instrument of Delegation - Council to Members of Staff(PDF, 2MB) - Used by Council to delegate Council powers, duties and functions within various Acts and Regulations (or specific parts of those Acts or Regulations), which contain a specific power of delegation.

S7 Instrument of Sub-Delegation by CEO - Used by the CEO to sub-delegate Council powers, duties or functions contained in Acts or Regulations which do not include a specific power of delegation pursuant to s47(1)(a) of the Local Government Act 2020.

S13 Instrument of Delegation by CEO of CEO powers - Used by the CEO to delegate their powers, duties and functions pursuant to S47(2) of the Local Government Act 2020. Lists the CEO powers under the Local Government Act 2020, Local Government Act 1989 & various other Victorian legislation.

S14 Instrument of Delegation by CEO for Vicsmart Applications under the Planning and Environment Act 1987 - Used by the CEO to delegate their powers as a responsible authority under the Planning and Environment Act 1987 in relation to VicSmart and future homes planning applications.

S16 Instrument of Delegation by Chief Executive Officer for Bushfire Reconstruction - Used by the CEO to delegate the powers under the Planning and Environment Act 1987 in respect of bushfire reconstruction applications.

S18 Instrument of Sub-Delegation Under the Environment Protection Act 2017(PDF, 896KB) - Used by Council to delegate to members of staff those powers that are contained in the Instrument of Delegation of the Environment Protection Authority under the Environment Protection Act 2017 dated 4 June 2021.

S19A Instrument of Delegation Municipal Fire Prevention Officer under the Country Fire Authority Act 1958 - Used by the Municipal Fire Prevention Officer (appointed using S11) to delegate their powers, functions and duties to the Assistant Fire Prevention Officer. This instrument should be used if Council is within a country area of Victoria (CFA). Mansfield Shire is in a CFA area.

S20A Instrument of Delegation (Child Wellbeing and Safety Act 2005) - Used by the CEO to delegate powers of appointment/authorisation under the Child Wellbeing and Safety Act 2005 to other staff who more frequently work in the space of MCH services, as directed by the Department of Education.

C7 Instrument of Delegation by CEO to the Station Precinct Museum Complex Community Asset Committee(PDF, 669KB) - Used by the CEO to delegate to members of the Station Precinct Museum Complex Community Asset Committee any power, duty or function of the Council that has been delegated to the CEO by the Council.

Authorisations

S11 Instrument of Appointment and Authorisation - Used by Councils to authorise or appoint a person to a particular statutory position. Individual authorisations, ongoing as required.

S11A Instrument of Appointment and Authorisation (Planning and Environment Act 1987)(PDF, 880KB) - Used by Council to authorise officers under the Environment Protection Act 2017 and institute proceedings on behalf of the council or represent the council in accordance with the Instrument of Direction of the Environment Protection Authority dated 4 June 2021.

S11B Instrument of Appointment and Authorisation (Environment Protection Act 2017) - Used by Council to authorise officers under the Environment Protection Act 2017 and in accordance with the Instrument of Direction of the Environment Protection Authority dated 4 June 2021.

S15 Instrument of Appointment and Authorisation of Council’s FOI Officer - Used by Council to authorise and appoint Council FOI Officer/s to make decisions on requests made under ss 17 and 39 of the Freedom of Information Act 1982.

S20B Instrument of Appointment and Authorisation (Child Wellbeing and Safety Act 2005) - Used by Council to authorise officers under s46K(1)(g) & S46K(1)(h) of the Child Wellbeing and Safety Act.
