We're reminding pool and spa owners that while it might be the start of winter, all Victorian swimming pools and spas are required to be registered by 1 June – yes, in two weeks’ time!
The Victorian Government introduced new swimming pool and spa safety laws on 1 December 2019 along with a new compliance program to ensure swimming pool and spa safety standards are being met.
Mansfield Shire Mayor, Cr Marg Attley OAM, said complying with the new laws is a two-step process. “First, pool and spa owners need to register their pool or spa with Council. Following the registration, a certificate of compliance is required. The age of the pool determines the deadline for the certificate of compliance,” Cr Attley said.
“Council is encouraging all owners to be proactive and register their pool or spa with Council prior to this due date for the safety of everyone.
“The new requirements are to ensure all pools and spas have the required fencing", she said. "If you are not sure what you need to meet the requirements, please phone our Building Services team so they can provide you with the information you need,” she said.
The registration fee of $31 can be paid with a credit card using both the online registration form and the printable form. An information search fee is also applicable but will be waived if Council can easily determine the swimming pool or spa construction date using its existing permit data base. If, however, further investigation is required to determine the construction date, an additional fee of $46 may be applicable.
Once registered, owners will be requested to submit the first certificate of pool and spa barrier compliance to verify that the swimming pool or spa is safe.
Pools and spas constructed prior to June 1994 must have their inspection and certificate of compliance by 1 June 2021, while pools and spas constructed between June 1994 and April 2010 need to have been through the process by 1 June 2022. Pools and spas constructed after May 2010 will have until 1 June 2023 to comply. Once pools are inspected, owners will have up to 60 days to rectify any problems (non-compliance) with the barrier.
Failure to register your pool or spa with Council is a breach of the Building Act1993 and can incur penalty infringements up to $330 and is a prosecutable offence of up to 10 units or $1652.
